Twelve months after handover, a client rings about a cracked lintel and nobody can say whether the liability period has run out. This holds one defects liability period per job with a start date, an end date, the duration in months and the terms. What is a defects liability period?
A set period after practical completion, usually 12 months, when you’re still on the hook to come back and put right defects that show up. It isn’t snagging. The works are finished and handed over. What’s left is a contractual tail.
How is a warranty defect different from a snag?
A snag turns up before handover, found by you or your inspector, and gets cleared before the client accepts the work. A warranty defect turns up after, usually reported by the client, and it carries a target date and a liability that stops when the period does. Two different animals, so they’re two different records.
Can clients report a warranty defect themselves?
Yes, through the Client Portal. It lands against the warranty period with the reporter’s name and the route it came in by. Better than a phone call, because a dated record inside the liability period is worth something and a half-remembered conversation isn’t.
